GENERAL TERMS AND CONDITIONS FOR BICYCLE RENTAL

These are the general bicycle rental terms and conditions of BIKE THE WAY, hereinafter referred to as MALLORCA FUN TEAM SL, Tax ID (CIF) B56199862.

The equipment must be picked up and returned by the customer at our premises located at Camp de s’Oca Nº13, ground floor, 07100 Sóller, Balearic Islands, Spain, unless otherwise agreed with MALLORCA FUN TEAM SL and confirmed in your reservation. The rental period is specified in your reservation. The term "equipment" in this contract refers to the rented item and its accessories.

The equipment must be returned on or before the "Rental End Date and Time" stated in the reservation. Late returns will incur a penalty of €20.00 per hour. If the equipment is returned more than 5 hours late, a fee equivalent to twice the daily rental rate will be charged per day.

The bicycle rental service is intended for adults. However, minors aged 16 to 18 may use the service with express and responsible authorization from a parent or legal guardian. Children under 16 must always be accompanied and supervised by a responsible adult.

All bikes come with a spare tube, tire levers, multitool, patch kit, and a pump. There is no charge for using the spare tube in case of a flat tire. Any other item (e.g., multitool, tire levers, or pump) not returned will incur a €20 fee per item.

The customer confirms having inspected the equipment and found it to be in perfect working condition upon signing this agreement.

The rented equipment must be returned in the same condition in which it was delivered, except for normal wear and dirt from daily use. If the equipment is returned damaged—either partially or totally—the customer will be responsible for the cost of repair or replacement, at the discretion of MALLORCA FUN TEAM SL.

Customers may opt for an additional service called "Partial Damage Coverage", offered by MALLORCA FUN TEAM SL for an extra fee indicated in the booking.

The customer agrees to take proper care of the rented equipment and take all necessary precautions to prevent damage, loss, or theft. If any such incident occurs during the rental period, the customer will be liable for all corresponding repair or replacement costs, as determined by MALLORCA FUN TEAM SL.

At the end of the rental period, MALLORCA FUN TEAM SL will inspect the condition of the returned equipment. Any loss or damage (excluding normal wear and dirt) will be assessed, and corresponding charges may be deducted from the credit card held on file as a security deposit.

The customer is responsible for supervising the equipment during the rental period. If necessary, a lock may be requested, but the customer should never lose control of the rented equipment.

The customer confirms being in good health, capable of operating the rented equipment, and having appropriate travel and/or health insurance to participate in cycling activities in Mallorca.

If a customer rents more than one bicycle, they confirm that all riders using those bicycles are in good health, capable of operating the equipment, and have the necessary travel and/or health insurance for cycling activities in Mallorca.

The rental does not include personal or third-party damage insurance. The customer is fully responsible for any personal injury or material damage caused or suffered.

If the customer makes a full or partial payment for a rental, they are deemed to have automatically accepted these Terms and Conditions.

The customer and their companions declare that they have read and understood these Terms and Conditions of MALLORCA FUN TEAM SL.

Customer data will be used solely for the proper execution of the rental service. In accordance with data protection laws, customers may request access, rectification, cancellation, or objection via any communication channel with MALLORCA FUN TEAM SL.

This contract is governed by Spanish law.

SPECIFIC TERMS AND CONDITIONS FOR BICYCLE RENTAL

By signing this contract, the user agrees to:

• Use the bicycle with maximum care and responsibility.

• Be responsible for the bicycle during the rental period and return it in the same condition it was received.

• Take appropriate measures to prevent its loss, theft, or damage.

• Ensure the bicycle is in proper working condition before taking it.

• Obey all Spanish traffic laws and ride responsibly, respecting pedestrians.

• Immediately report any incidents involving the bicycle (e.g., breakdown, accident, theft).

Prohibited actions:

• Lending, subleasing, or transferring the bicycle to third parties.

• Dismantling or tampering with any part of the bicycle.

• Using the bicycle for commercial purposes.

Payment Conditions:
Deposits are collected during the reservation process via website, phone, or email through online payment.

Cancellation Policy – Book with Confidence:

No refunds or credits are issued once the rental period has started. If we are forced to cancel the rental, a 100% refundwill be granted.

Cancellation Timeline:

• Up to 4 days before rental start date – Full refund

• Between 3 days and 24 hours before – 50% refund

• Same-day cancellation (No Show) – No refund

To confirm your rental and these terms and conditions, you must pay the deposit to MALLORCA FUN TEAM SL before the rental period begins.

Late returns will be charged double the published daily rental rate per day.

A valid personal ID and credit card are required at the start of any rental period. In some cases, MALLORCA FUN TEAM SL may request an additional deposit.

If the customer fails to meet the above requirements, MALLORCA FUN TEAM SL reserves the right to charge reasonable fees until the equipment is returned. In the case of damaged equipment, the customer is responsible for the replacement or repair cost (whichever is cheaper), restoring the equipment to its pre-rental condition.

Normal wear and tear—as defined by the manufacturer—is accepted and included in the rental price.

Personal Safety:

It is the rider’s responsibility to ensure their own safety. Cycling involves inherent risk. Riders must act responsibly.

Injuries or death can result from weather, high speed, collisions, third-party intervention, rider inexperience, human error, or equipment misuse.

Inexperienced cyclists must ride under the supervision of an experienced rider.

Do not ride under the influence of alcohol, drugs, medication, or while fatigued.

MALLORCA FUN TEAM SL is not liable for death, personal injury, or losses suffered by the customer or third parties—whether persons or property.

MALLORCA FUN TEAM SL’s liability under this contract is limited to the total cost of the reservation.

In the event of force majeure, MALLORCA FUN TEAM SL is not liable if unable to fulfill a reservation. In such cases, no cancellations will be permitted, but rescheduling is possible.
